Predmet javne nabavke određen je članom 175 stav 1 tačka 4 Zakona o javnim nabavkama („Službeni list CG“, br. 074/19) jer se radi o usluzi samo za vojne namjene odnosno transportu specijalnih oklopnih vozila koji su predviđeni pod tačkom 6 podtačka b Liste 1 Uredbe o listi vojne opreme i proizvoda, postupku i načinu sprovođenja javnih nabavki u oblasti odbrane i bezbjednosti ("Službeni list Crne Gore", br. 076/20 od 28.07.2020). Pravni osnov za sprovođenje predmetnog postupka je član 5 i tačka 1 stav 1 podtačka 3 Priloga 1 Uredbe o listi vojne opreme i proizvoda, postupku i načinu sprovođenja javnih nabavki u oblasti odbrane i bezbjednosti ("Službeni list Crne Gore", br. 076/20 od 28.07.2020) odnosno član 59 stav 1 tačka 3 Zakona o javnim nabavkama („Službeni list CG“, br. 074/19). Na osnovu ukazane potrebe za uslugom transporta 10 JLTV vozila iz Sjedinjenih Američkih Država neophodno je hitno realizovati postupak nabavke saglasno članu 59 st.1 tač. 3 Zakona o javnim nabavkama („Službeni list CG“, br. 074/19) zbog postojanja opasnosti od naplate raznih novčanih penala u slučaju odlaganja transporta. Naime dana 30.06.2021. godine dopisom (u prilogu) Ministarstvo odbrane Crne Gore obratilo se Kancelariji za odbrambenu saradnju ODC, kao nadležnoj instanci u Sjedinjenih Američkih Država u Crnoj Gori za realizaciju nabavke JLTV vozila, sa zahtjevom da se planirana isporuka za 2021. godinu od 10 JLTV vozila odloži za drugu polovinu 2022. godine. Navedeno odlaganje je traženo zbog budžetskih problema uzrokovanih privremenim finansiranjem kao i nedostatkom finansijskih sredstava.U međusobnoj komunikaciji najavljeno nam je da bi naš zahtjev trebao biti prihvaćen.Dana 15.12.2021. godine predstavnik ODC kancelarije je obavijestio Ministarstvo odbrane Crne Gore da je naš zahtjev za odlaganje odbijen, i da moramo hitno izvršiti preuzimanje vozila i transportovati ih za Crnu Goru, i da ako to ne učinimo odmah njihova strana početi obračunavanje troškova skladištenja i održavanja na mjesečnom nivou. Shodno stručnom uputstvu o primjeni zakona o javnim nabavkama direktorata za politiku javnih nabavki ministarstva finansija i socijalnog staranja predmetnu nabavku nije potrebno planirati. Ponuda se sačinjava u ESJN u skladu sa tenderskom dokumentacijom i prema uputstvu za sačinjavanje i podnošenje ponude putem elektronskog sistema javnih nabavki. U skladu sa mogućnošću predviđenom tačkom 46 stav 2 Priloga 1 Uredbe o listi vojne opreme i proizvoda, postupku i načinu sprovođenja javnih nabavki u oblasti odbrane i bezbjednosti („Službeni list Crne Gore“, broj 76/20), Naručilac isključuje obavezu dostavljanja Izjave privrednog subjekta o ispunjenosti uslova za učešće u postupku javne nabavke. S tim u vezi, Naručilac je u skladu sa tačkom 51 stav 1 i tačkom 46 stav 1 Priloga 1 navedene Uredbe propisao dokaze koje je potrebno dostaviti i način na koji se isti dostavljaju kako je i navedeno u tački 6. The legal basis for conducting the procedure in question is Article 5 and item 1, paragraph 1, sub-item 3 of Annex 1 Decree on the list of military equipment and products, procedure and manner of conducting public procurement in the field of defence and security ("Official Gazette of Montenegro", No. 076/20 of 28.07.2020) that is, Article 59, paragraph 1, item 3 Law on Public Procurement ("Official Gazette of Montenegro", No. 074/19). Based on the indicated need for the transport service of 10 JLTV vehicles from the United States of America, it is necessary to urgently implement the procurement procedure in accordance with Article 59, paragraph 1, item 3 of the Law on Public Procurement ("Official Gazette of Montenegro", No. 074/19) due to the danger of collecting various fines in case of transport delays. Namely on 30.06.2021. In a letter (attached), the Ministry of Defence of Montenegro addressed the Office for Defence Cooperation of the ODC, as the competent authority in the United States of America in Montenegro for the procurement of JLTV vehicles, with a request to postpone the planned delivery of 10 JLTV vehicles for 2021. the second half of 2022. The stated postponement was requested due to budget problems caused by temporary financing as well as the lack of financial resources. We were informed in our mutual communication that our request should be accepted. On December 15, 2021. The representative of the ODC office informed the Ministry of Defence of Montenegro that our request for postponement was rejected, and that we must urgently take over the vehicles and transport them to Montenegro, and that if we do not do so, their side will start calculating storage and maintenance costs on a monthly basis. Pursuant to the expert instructions on the application of the Public Procurement Law of the Public Procurement Policy Directorate of the Ministry of Finance and Social Welfare, it is not necessary to plan the procurement in question. The bid is made in the ESJN in accordance with the tender documentation and according to the instructions for preparing and submitting the bid through the electronic public procurement system. In accordance with the possibility provided for in item 46 paragraph 2 of Annex 1 to the Decree on the list of military equipment and products, procedure and manner of conducting public procurement in the field of defence and security ("Official Gazette of Montenegro", No. 76/20), the Contracting Authority excludes subject on fulfillment of conditions for participation in the public procurement procedure. In this regard, in accordance with point 51 paragraph 1 and point 46 paragraph 1 of Annex 1 to the said Regulation, the Contracting Authority prescribed the evidence to be submitted and the manner in which it is submitted as stated in point 6 of the Tender Documentation.
