PREDMET NABAVKE 1. UPRAVA ZA UGLJOVODONIKE - Naftni derivati CPV: 09134220 Procijenjena vrijednost: 11000000 EUR USLOVI UČEŠĆA 1. U postupku javne nabavke može da učestvuje samo privredni subjekat koji: nije pravosnažno osuđivan i čiji izvršni direktor nije pravosnažno osuđivan za neko od krivičnih djela sa obilježjima: a) kriminalnog udruživanja; b) stvaranja kriminalne organizacije; c) davanje mita; č) primanje mita; ć) davanje mita u privrednom poslovanju; d) primanje mita u privrednom poslovanju; dž) utaja poreza i doprinosa; đ) prevare; e) terorizma; f) finansiranja terorizma; g) terorističkog udruživanja; h) učestovanja u stranim oružanim formacijama; i) pranja novca; j) trgovine ljudima; k) trgovine maloljetnim licima radi usvojenja; l) zasnivanja ropskog odnosa i prevoza lica u ropskom odnosu što se dokazuje na osnovu uvjerenja, potvrde ili drugog akta nadležnog organa izdatog na osnovu kaznene evidencije, u skladu sa propisima države u kojoj privredni subjekat ima sjedište, odnosno u kojoj ovlašćeno lice tog privrednog subjekta ima prebivalište. /Only a business entity that meets the following requirement may participate in the public procurement procedure: the business entity has not been finally convicted, and its executive director has not been finally convicted, for any of the following criminal offences: a) criminal association, b) creation of a criminal organisation, c) giving bribes, d) receiving bribes, e) giving bribes in business operations, f) receiving bribes in business operations, g) tax and contribution evasion, h) fraud, i) terrorism, j) financing of terrorism, k) terrorist association, l) participation in foreign armed formations, m) money laundering, n) human trafficking, o) trafficking in minors for the purpose of adoption, p) establishing a slave relationship and transporting persons in a slave relationship. Compliance with this requirement shall be demonstrated by a certificate, confirmation, or other document issued by the competent authority based on criminal records, in accordance with the regulations of the state in which the business entity has its registered seat, or in which the authorised representative of that business entity has permanent residence. 2. U postupku javne nabavke može da učestvuje samo privredni subjekat koji je izmirio sve dospjele obaveze po osnovu poreza i doprinosa za penzijsko i zdravstveno osiguranje, o kojima evidenciju vodi organ uprave nadležan za naplatu poreskih prihoda, odnosno nadležni organ države u kojoj privredni subjekat ima sjedište što se dokazuje na osnovu uvjerenja, potvrde ili drugog akta koji izdaje organ uprave nadležan za naplatu poreskih prihoda, odnosno nadležni organ države u kojoj privredni subjekat ima sjedište. / Only a business entity that has settled all due obligations arising from taxes and contributions for pension and health insurance, as recorded by the public authority responsible for the collection of tax revenues, or by the competent authority of the state in which the business entity has its registered seat, may participate in the public procurement procedure. Compliance with this requirement shall be evidenced by a certificate, confirmation, or other document issued by the public authority responsible for the collection of tax revenues, or by the competent authority of the state in which the business entity has its registered seat. 3. U postupku javne nabavke može da učestvuje samo privredni subjekat koji je upisan u Centralni registar privrednih subjekata ili drugi odgovarajući registar u državi u kojoj privredni subjekat ima sjedište što se dokazuje na osnovu dokaza o registraciji u Centralnom registru privrednih subjekata ili drugom odgovarajućem registru u državi u kojoj privredni subjekat ima sjedište, sa podacima o ovlašćenom licu, odnosno izvršnom direktoru privrednog subjekta. / Only a business entity that is registered in the Central Register of Business Entities or in another appropriate register in the state in which the business entity has its registered seat may participate in the public procurement procedure. Privredni subjekat je dužan da posjeduje minimum iskustva na kvalitetnom i uspješnom izvršavanju istih ili sličnih poslova iz oblasti predmeta nabavke i to: Minimum 1 (jedna) potvrda o kvalitetnom i uspješnom izvršavanju istih ili sličnih poslova iz oblasti predmeta nabavke u predhodne dvije godine računajući I godinu u kojoj je započet postupak javne nabavke. Pod istim poslovima iz oblasti predmeta javne nabavke podrazumijeva se isporuka eurodizela (EN 590) goriva brodom u međunarodnoj trgovini minimalne količine 15.000 metričkih tona. Pod sličnim poslovima podrazumijeva se isporuka motornog benzina (EN 228) ili JET-A-1 goriva brodom u međunarodnoj trgovini minimalne količine 15.000 metričkih tona. Naručilac će u postupku provjere izjave privrednog subjekta, radi utvrđivanja ispunjenosti navedenog uslova, tražiti sljedeće dokaze: Potvrde izdate od korisnika, o isporučenoj robi u predhodne dvije godine, računajući I godinu u kojoj je započet postupak javne nabavke koje sadrže opis predmeta nabavke,vrijednost izvršenog ugovora i vrijeme realizacije ugovora i konstataciju da je ugovor blagovremeno I kvalitetno izvršen. / The business entity shall be required to possess at least a minimum level of experience in the proper and successful performance of the same or similar activities falling within the subject matter of the procurement, namely: A minimum of one (1) certificate confirming the proper and successful performance of the same or similar activities falling within the subject matter of the procurement during the previous two years, including the year in which the public procurement procedure was initiated. For the purposes of this requirement, “same activities” within the subject matter of the public procurement shall mean the delivery of eurodiesel (EN 590) fuel by vessel in international trade, in a minimum quantity of 15,000 metric tonnes. “Similar activities” shall mean the delivery of motor gasoline (EN 228) or JET-A-1 fuel by vessel in international trade, in a minimum quantity of 15,000 metric tonnes. In the process of verifying the statement of the business entity, for the purpose of determining fulfilment of this requirement, the contracting authority shall request the following evidence: Certificates issued by the end-users for goods delivered during the previous two years, including the year in which the public procurement procedure was initiated, containing a description of the subject of procurement, the value of the completed contract, the period of contract performance, and a confirmation that the contract was performed timely and with the required quality. 5. Izjava privrednog subjekta (verifikovana elektronskim potpisom) kojom ponuđač garantuje da će u toku trajanja postupka javne nabavke i realizacije ugovora o javnoj nabavci ispunjavati sve uslove za učešće u postupku javne nabavke i da ne postoji osnov za isključenje iz postupka javne nabavke, predviđen tenderskom dokumentacijom. Ponuđač je dužan da tačno, potpuno, pravilno i nedvosmisleno popuni Izjavu privrednog subjekta u skladu sa zahtjevima iz tenderske dokumentacije. / A statement of the business entity (verified by electronic signature) by which the tenderer guarantees that, throughout the duration of the public procurement procedure and the performance of the public procurement contract, it will meet all requirements for participation in the public procurement procedure and that no grounds for exclusion from the public procurement procedure, as prescribed in the tender documentation, exist. The tenderer shall be obliged to complete the Statement of the Business Entity accurately, fully, correctly, and unambiguously, in accordance with the requirements set out in the tender documentation. 6. Rok važenja ponude je 60 dana od dana otvaranja ponuda. Validity period of the bid 60 days from the date of the opening of bids. 7. Rok plaćanja je u roku od 10 dana od ovjerene obračunske fakture. The payment deadline shall be ten (10) days from the date of the certified invoice. 8. Plaćanje će se izvršiti jednokratno, po završetku isporuke ukupno ugovorene količine robe, u roku od 10 dana od dostavljanja originalne obračunske fakture, originalnog punog seta prevoznih dokumenata uključujući set od 3/3 čiste teretnice, izdate ili ovjerene na ime Kupca, sa napomenom “Prevoz plaćen prema Ugovoru o prevozu”, originalnog Sertifikata o količini izdatog u luci istovara od strane nezavisnog kontrolnog tijela tip A, akreditovanog prema normi MEST EN ISO 17020, originalnog Sertifikata o kvalitetu izdatog u luci istovara od strane nezavisnog kontrolnog tijela tip A, akreditovanog prema normi MEST EN ISO 17020, kojim se potvrđuje da je testirana kvaliteta Robe u skladu sa zahtjevima Ugovora, originalnog Sertifikata o količini izdatog u luci utovara od strane nezavisnog kontrolnog tijela tip A, akreditovanog prema normi EN ISO 17020, kojim se potvrđuje da je količina Robe u skladu sa zahtjevima Ugovora, originalnog Sertifikata o kvalitetu izdatog u luci utovara od strane nezavisnog kontrolnog tijela tip A, akreditovanog prema normi EN ISO 17020, kojim se potvrđuje da je testirana kvaliteta Robe u skladu sa zahtjevima Ugovora, originalnog Sertifikata o porijeklu, Safety Data Sheet-a izdatog od strane proizvođača Eurodizela, koji sadrži CAS broj i REACH registracijski broj, Garancije za dobro izvršenje ugovora. Payment shall be made in a single instalment, upon completion of the delivery of the total contracted quantity of goods, within ten (10) days from the submission of the original commercial invoice, the original full set of transport documents, including a set of 3/3 clean bills of lading issued or endorsed to the Buyer, bearing the notation “Freight Payable as per Charter Party” the original Outturn Certificate issued at the port of discharge by an independent Type A inspection body accredited in accordance with the MEST EN ISO 17020 standard, the original Quality Certificate issued at the port of discharge by an independent Type A inspection body accredited in accordance with the MEST EN ISO 17020 standard, confirming that the tested quality of the Goods complies with the requirements of the Contract, the original Outturn Certificate issued at the port of loading by an independent Type A inspection body accredited in accordance with the EN ISO 17020 standard, confirming that the quantity of the Goods complies with the requirements of the Contract, the original Quality Certificate issued at the port of loading by an independent Type A inspection body accredited in accordance with the EN ISO 17020 standard, confirming that the tested quality of the Goods complies with the requirements of the Contract, the original Certificate of Origin, the Safety Data Sheet issued by the Eurodiesel manufacturer containing the CAS number and the REACH registration number, and the Performance Guarantee. 9. Mjesto izvršenja ugovora: Luka Bar (Opština Bar). Place of Contract Performance: Port of Bar (Municipality of Bar). 10. Ponuđač je dužan dostaviti bezuslovnu i na prvi poziv naplativu garanciju ponude u iznosu od 2 % procijenjene vrijednosti javne nabavke, kao garanciju ostajanja u obavezi prema ponudi u periodu važenja ponude i 10 dana nakon isteka važenja ponude. Garancija ponude je sredstvo zaštite naručioca ako ponuđač: 1) odustane od ponude u roku važenja ponude i/ili 2) odbije da zaključi ugovor o javnoj nabavci ili okvirni sporazum. Garancija ponude podnosi se u elektronskom obliku putem ESJN-a. Izuzetno od prethodnog stava, ako ponuđač ne može da garanciju ponude podnese u elektronskom obliku, dužan je da putem ESJN dostavi kopiju garancije ponude, a da original garancije ponude dostavi, odnosno uruči naručiocu neposredno ili putem pošte preporučenom pošiljkom najkasnije prije isteka roka za podnošenje ponuda./ The tenderer shall be required to submit an unconditional, on-first-demand, payable bid guarantee in the amount of 2% of the estimated value of the public procurement, as security for the tenderer’s commitment to remain bound by its bid during the bid validity period and for ten (10) days following the expiry of the bid validity period. The bid guarantee constitutes a means of protection for the contracting authority in the event that the tenderer: withdraws its bid during the bid validity period; and/or refuses to conclude the public procurement contract or the framework agreement. The bid guarantee shall be submitted in electronic form via the ESPP. As an exception to the previous paragraph, if the tenderer is unable to submit the bid guarantee in electronic form, it shall be required to submit a copy of the bid guarantee via the ESPP, and to submit or deliver the original bid guarantee to the contracting authority in person or by registered mail no later than before the expiry of the deadline for submission of bids. 11. Ponuđač čija ponuda bude izabrana kao najpovoljnija je dužan da uz potpisan ugovor o javnoj nabavci dostavi Naručiocu Garanciju za dobro izvršenje ugovora, ako je raskid ugovora nastao zbog neispunjenja ugovorenih obaveza nastalih činjenjem ili nečinjenjem ponudjača, u iznosu od 10% od vrijednosti ugovora sa rokom važenja 60 dana duže od ponuđenog roka izvršenja ugovora. Ponuđač čija ponuda bude izabrana kao najpovoljnija je dužan da na zahtjev Naručioca produži rok važenja Garancije za dobro izvršenje ugovora tj. da održava Garanciju do isporuke ukupno ugovorene količine robei dobijanja uredne prateće dokumentacije. Garancija za dobro izvršenje ugovora mora biti neopoziva i bezuslovno plativa na prvi poziv. /The tenderer whose bid is selected as the most advantageous shall, together with the signed public procurement contract, submit to the Contracting Authority a Performance Guarantee, in the event that termination of the contract occurs due to non-fulfilment of contractual obligations arising from the tenderer’s acts or omissions, in the amount of 10% of the contract value, with a validity period extending 60 days beyond the offered contract performance period. The tenderer whose bid is selected as the most advantageous shall, at the request of the Contracting Authority, extend the validity period of the Performance Guarantee, i.e., maintain the Guarantee in force until the delivery of the total contracted quantity of goods and the receipt of complete and compliant accompanying documentation. The Performance Guarantee must be irrevocable and unconditionally payable on first demand. 12. Kontrola kvaliteta vršiće se prije istovara i sprovodi se na uzorku (analiza vizualnog izgleda, boja, sadržaj sumpora, destilacija, CFPP koji smije iznositi najviše -15 °C, sadržaj vode i gustina) uzetom sa broda u luci Bar. Nakon toga biće izdat Sertifikat o kvalitetu koji specifikuje sve parametre kvaliteta u skladu sa MEST EN 590, Pravilnikom o kvalitetu i kontroli kvaliteta tečnih goriva naftnog porijekla (Sl. list, br. 1/2016 i 21/2021) i Ugovorom. Sertifikat o kvalitetu izdaje nezavisno kontrolno tijelo tip A , akreditovano prema zahtjevu norme MEST EN ISO/IEC 17020. Laboratorija koja pruža usluge analize kvaliteta takvom kontrolnom tijelu treba da ispuni sve zahtjeve/standarde u skladu sa MEST ISO 17025. /Quality control shall be carried out prior to discharge and shall be performed on a sample taken from the vessel in the Port of Bar (visual appearance analysis, colour, sulphur content, distillation, CFPP not exceeding -15°C, water content, and density). Following this, a Quality Certificate shall be issued specifying all quality parameters in accordance with MEST EN 590, the Rulebook on the Quality and Quality Control of Petroleum-Based Liquid Fuels (Official Gazette Nos. 1/2016 and 21/2021), and the Contract. The Quality Certificate shall be issued by an independent Type A inspection body accredited in accordance with the requirements of the MEST EN ISO/IEC 17020 standard. The laboratory providing analytical services to such an inspection body shall meet all requirements/standards in accordance with MEST ISO 17025. 13. Eurodizel mora biti proizveden poslije 21. januara 2026. godine i ne smije biti proizveden preradom sirove nafte porijeklom iz Ruske Federacije. U cilju dokazivanja ispunjenosti navedenog zahtjeva, ponuđač će, prije isporuke eurodizela, naručiocu dostaviti sljedeću dokumentaciju, zavisno od zemlje porijekla eurodizela: a) Ako je Eurodizel proizveden u EU ili u zemljama navedenim u članu 3ma(1) i Dodatku LI Uredbi Savjeta (EU) br. 833/2014, Prodavac će dostaviti Safety Data Sheet (SDS) izdat od strane proizvođača Eurodizela, koji mora sadržati identifikaciju proizvođača, datum izdavanja dokumenta i sve podatke relevantne za porijeklo i specifikaciju goriva, kao i Sertifikate o količini i kvalitetu Eurodizela izdate u luci utovara od strane nezavisnog kontrolnog tijela tip A, akreditovanog prema zahtjevu norme EN ISO/IEC 17020, i Sertifikat o porijeklu Eurodizela; b) Ako je Eurodizel proizveden u trećoj zemlji koja je, prema podacima Međunarodne agencije za energiju (IEA) na dan 29. oktobar 2025. godine, bila neto izvoznica sirove nafte u 2024. godini, Prodavac će dostaviti Safety Data Sheet (SDS) izdat od strane proizvođača Eurodizela, koji mora sadržati identifikaciju proizvođača, datum izdavanja dokumenta i sve podatke relevantne za porijeklo i specifikaciju Eurodizela, kao i Sertifikate o količini i kvalitetu Eurodizela koji su izdati u luci utovara od strane nezavisnog kontrolnog tijela tip A, akreditovanog prema zahtjevu norme EN ISO/IEC 17020, i Sertifikat o porijeklu Eurodizela; c) Ako je Eurodizel proizveden u trećoj zemlji koja, prema podacima Međunarodne agencije za energiju na dan 29. oktobar 2025. godine, nije bila izvoznica sirove nafte u 2024. godini, Prodavac će, uz Safety Data Sheet (SDS), Sertifikate o količini i kvalitetu Eurodizela izdane u luci utovara od strane nezavisnog kontrolnog tijela tip A, akreditovanog prema zahtjevu norme EN ISO/IEC 17020 i Sertifikat o porijeklu Eurodizela, dostaviti i jednu od sljedećih potvrda, zavisno od tehnologije rafinerije: ako rafinerija može razdvojiti i zasebno preraditi rusku naftu – potvrdu rafinerije, sastavljenu od treće nezavisne strane (attestation of assurance), da je Eurodizel proizveden iz „proizvodne linije“ koja koristi isključivo sirovu naftu koja nije porijeklom iz Ruske Federacije; ako rafinerija ne može razdvojiti i zasebno preraditi rusku naftu – potvrdu treće nezavisne strane (attestation of assurance) da rafinerija u periodu od 60 dana koji prethode datumu izdavanja teretnice za brod sa Eurodizelom koji je predmet ove nabavke, nije primila niti preradila sirovu naftu iz Ruske Federacije. Ako je način isporuke In-Tank, ponuđač je dužan da prije isporuke Eurodizela dostavi naručiocu: Safety Data Sheet (SDS) izdat od strane proizvođača, sa identifikacijom proizvođača, datumom izdavanja i svim relevantnim podacima o porijeklu i specifikaciji goriva; i Sertifikat o porijeklu robe./ Eurodiesel must be produced after 21 January 2026 and must not be manufactured from crude oil originating from the Russian Federation. To demonstrate compliance with this requirement, the tenderer shall, prior to the delivery of the Eurodiesel, provide the Contracting Authority with the following documentation, depending on the country of origin of the Eurodiesel: a) If the Eurodiesel is produced in the EU or in the countries listed in Article 3ma(1) and Annex LI of Council Regulation (EU) No. 833/2014, the Seller shall submit a Safety Data Sheet (SDS) issued by the Eurodiesel manufacturer, which must include the identification of the manufacturer, the date of issue of the document, and all information relevant to the origin and specification of the fuel, as well as the Quantity and Quality Certificates for the Eurodiesel issued at the port of loading by an independent Type A inspection body accredited in accordance with the requirements of the EN ISO/IEC 17020 standard, and the Certificate of Origin of the Eurodiesel. b) If the Eurodiesel is produced in a third country which, according to the International Energy Agency (IEA) data as at 29 October 2025, was a net exporter of crude oil in 2024, the Seller shall submit a Safety Data Sheet (SDS) issued by the Eurodiesel manufacturer, which must include the identification of the manufacturer, the date of issue of the document, and all information relevant to the origin and specification of the Eurodiesel, as well as the Quantity and Quality Certificates for the Eurodiesel issued at the port of loading by an independent Type A inspection body accredited in accordance with the requirements of the EN ISO/IEC 17020 standard, and the Certificate of Origin of the Eurodiesel. c) If the Eurodiesel is produced in a third country which, according to the International Energy Agency data as at 29 October 2025, was not an exporter of crude oil in 2024, the Seller shall, in addition to the Safety Data Sheet (SDS), the Quantity and Quality Certificates for the Eurodiesel issued at the port of loading by an independent Type A inspection body accredited in accordance with the requirements of the EN ISO/IEC 17020 standard, and the Certificate of Origin of the Eurodiesel, provide one of the following confirmations, depending on the refinery technology: – If the refinery is able to segregate and separately process Russian crude oil – a refinery confirmation, prepared by a third independent party (attestation of assurance), stating that the Eurodiesel was produced from a “production line” using exclusively crude oil not originating from the Russian Federation. – If the refinery is not able to segregate and separately process Russian crude oil – a confirmation from a third independent party (attestation of assurance) stating that, during the 60-day period preceding the date of issuance of the bill of lading for the vessel carrying the Eurodiesel subject to this procurement, the refinery did not receive or process crude oil originating from the Russian Federation. If the method of delivery is In-Tank, the tenderer shall, prior to delivery of the Eurodiesel, submit to the Contracting Authority: a Safety Data Sheet (SDS) issued by the manufacturer, containing the identification of the manufacturer, the date of issue, and all relevant information on the origin and specification of the fuel; and the Certificate of Origin of the goods. 14. Paritet isporuke je DPU Naftni terminal u luci Bar, Crna Gora (INCOTERMS 2020) ili In-Tank Naftni terminal u luci Bar, Crna Gora. Svojina i rizik za Eurodizel koji je predmet ovog tendera prelaze sa ponuđača na naručioca u trenutku kada je Eurodizel prešao spojnu prirubnicu rezervoara na naftnom terminalu u luci Bar. Eurodizel se isporučuje u jednoj isporuci. U slučaju da je paritet isporuke DPU naftni terminal u luci Bar brod nominovan za prevoz robe mora imati dvostruki trup i ne smije biti stariji od 15 godina. Brod mora ispunjavati propise luke Bar i tehničke zahtjeve naftnog terminala u luci Bar. Brod ne smije prelaziti maksimalnu dužinu preko svega (LOA) od 230 m i maksimalni gaz od 12 m. Nominalni kapacitet istovara je 600 m3/h pri maksimalnom pritisku od 7.5 bar. Maksimalna visina istakačke ruke je 12 m (visina razvodnika iznad vodene linije u balastu/u SDWT stanju). Maksimalno dozvoljeno vrijeme za istovar eurodizela je 48 sati SHINC ("vikend i praznici uključeni") plus 6 sati od podnošenja obavještenja o spremnosti (NOR) ili od potpunog privezivanja broda na vez. Sve dažbine u luci kao i uslugu pretovara snosi ponuđač. Pritom, ponuđač može podnijeti samo jednu ponudu na jednom od dva zahtjevana pariteta. / The delivery parity shall be DPU Oil Terminal at the Port of Bar, Montenegro (INCOTERMS 2020) or In-Tank Oil Terminal at the Port of Bar, Montenegro. Title and risk for the Eurodiesel subject to this tender shall pass from the tenderer to the Contracting Authority at the moment when the Eurodiesel has crossed the manifold connection of the tank at the oil terminal in the Port of Bar. Eurodiesel shall be delivered in a single delivery. If the delivery parity is DPU Oil Terminal at the Port of Bar, the vessel nominated for the transport of the goods must be double-hulled and must not be older than 15 years. The vessel must comply with the regulations of the Port of Bar and the technical requirements of the oil terminal in the Port of Bar. The vessel must not exceed a maximum length overall (LOA) of 230 m and a maximum draft of 12 m. The nominal discharge capacity is 600 m³/h at a maximum pressure of 7.5 bar. The maximum height of the unloading arm is 12 m (height of the manifold above the waterline in ballast/SDWT condition). The maximum permitted time for unloading the Eurodiesel shall be 48 hours SHINC (“Saturdays, Sundays and Holidays Included”) plus 6 hours from the submission of the Notice of Readiness (NOR) or from the vessel’s complete berthing at the quay. All port charges as well as the transshipment service shall be borne by the tenderer. The tenderer may submit only one bid under one of the two required delivery parities. 15. Isporučenom količinom eurodizela smatraće se ona količina koja je navedena u Sertifikatu o količini utvrđena kontrolnim mjerenjem koje je sprovelo nezavisno kontrolno tijelo tip A, akreditovano prema zahtjevu norme MEST EN ISO/IEC 17020 na mjestu isporuke. Količina prihvaćene robe biće određena prema mjerama rezervoara u koji je eurodizel dopremljen, izračunato na temperaturi od 15 °C, iskazana zapreminski u kubičnim metrima i težinski u metričkim tonama, oboje u vazduhu („in air“). Količina navedena u Sertifikatu o količini biće fakturisana količina. / The delivered quantity of Eurodiesel shall be deemed to be the quantity indicated in the Outturn Certificate, determined by control measurement carried out by an independent Type A inspection body accredited in accordance with the requirements of the MEST EN ISO/IEC 17020 standard at the place of delivery. The quantity of accepted goods shall be determined based on the measurements of the tank into which the Eurodiesel has been delivered, calculated at a temperature of 15°C, expressed volumetrically in cubic metres and by weight in metric tonnes, both in air. The quantity stated in the Outturn Certificate shall be the invoiced quantity 16. Cijena Eurodizela biće iskazana na izabranom paritetu (DPU ili In-Tank) Naftni terminal u luci Bar, i utvrđuje se na osnovu prosjeka svih uzastopnih završnih cijena (closing price) za ICE Low Sulphur Gasoil Futures u USD po metričkoj toni, objavljenih na ICE grafiku (https://www.ice.com/products/34361119/low-sulphur-gasoil-futures/data?marketId=6227601&span=1 za 3 MONTHS) u periodu od 08. decembra 2025. do 22. decembra 2025. godine (oba datuma uključena), za April 2026, uvećano ili umanjeno za nepromjenjivu razliku (premium/discount) u USD po metričkoj toni koju nudi ponuđač. Cijene koje će objavljivati ICE Futures Europe u navedenom periodu (08. decembar – 22. decembar 2025, oba datuma uključena) dostupne su i u dnevnim izdanjima Platts European Marketscan – ICE Futures, u dijelu „ICE gasoil settlements (PGA page 702)“ za Low Sulphur Gasoil, april 2026. Cijena Eurodizela se iskazuje u EUR po metričkoj toni, a konverzija iz USD u EUR vrši se prema srednjem kursu Centralne banke Crne Gore za period od 08. decembra do 22. decembra 2025. godine (oba datuma uključena). Cijena uključuje i zapreminsko usklađivanje između referentne gustine dizela od 845 kg/m3 na 15 oC i stvarne gustine dizela na istovarnim instalacijama u luci Bar, koja se kreće od 815 kg/m3 do 845 kg/m3 na 15 oC (oboje u vazduhu – i.a.). Cijena u cjelosti uključuje sve troškove i obaveze koje snosi Prodavac do završetka isporuke Robe u rezervoare u naftnom terminalu u luci Bar. / The Eurodiesel price offered by the tenderer shall be determined based on the future prices for gasoil published by ICE Futures Europe for Low Sulphur Gasoil Futures. The Eurodiesel price shall be stated on the selected delivery parity (DPU or In-Tank) Oil Terminal at the Port of Bar and shall be established on the basis of the average of all consecutive closing prices for ICE Low Sulphur Gasoil Futures, expressed in USD per metric tonne, published on the ICE chart (https://www.ice.com/products/34361119/low-sulphur-gasoil-futures/data?marketId=6227601&span=1 for 3 MONTHS) for the period from 8 December 2025 to 22 December 2025 (both dates inclusive), for April 2026, increased or decreased by the fixed premium/discount in USD per metric tonne offered by the tenderer. The prices that will be published by ICE Futures Europe during the stated period (8 December – 22 December 2025, both dates inclusive) are also available in the daily editions of Platts European Marketscan – ICE Futures, in the section “ICE gasoil settlements (PGA page 702)” for Low Sulphur Gasoil, April 2026. The Eurodiesel price shall be quoted in EUR per metric tonne, and conversion from USD into EUR shall be carried out using the middle exchange rate of the Central Bank of Montenegro for the period from 8 December to 22 December 2025 (both dates inclusive). The price shall also include volumetric adjustment between the reference diesel density of 845 kg/m³ at 15°C and the actual diesel density at the discharge facilities in the Port of Bar, which ranges from 815 kg/m³ to 845 kg/m³ at 15°C (both in air). The price shall fully include all costs and obligations borne by the Seller until the completion of the delivery of the Goods into the tanks at the oil terminal in the Port of Bar. 17. Quality – delivery deadline shall be evaluated using the absolute evaluation method as follows: The tenderer offering a Eurodiesel delivery deadline in the first ten-day period of April 2026 (from 1 to 10 April 2026) shall receive 10 points. The tenderer offering a Eurodiesel delivery deadline in the second ten-day period of April 2026 (from 11 to 20 April 2026) shall receive 7 points. The tenderer offering a Eurodiesel delivery deadline in the third ten-day period of April 2026 (from 21 to 30 April 2026) shall receive 5 points. TEHNIČKA SPECIFIKACIJA 1. Eurodizel (EN 590) /Eurodiesel (EN 590) Eurodizel (engl. Ultra Light Sulphur Diesel 10ppm) mora biti u skladu sa MEST EN 590 posljednje izdanje i u skladu sa Pravilnikom o kvalitetu i kontroli kvaliteta tečnih goriva naftnog porijekla (Sl. list, br. 1/2016 i 21/2021), sa sadržajem sumpora 10ppm i graničnom CFPP (Cold Filter Plugging Point) vrijednosti od -15 C°. Pored toga, gorivo mora vizualnim pregledom biti bistro i čisto, bez izdvojene vode i sedimenata. Naručilac kupuje Eurodizel u skladu sa raspoloživim, opredijeljenim sredstvima (11.000.000 EUR), a u ukupnoj količini ne većoj od 16.500 metričkih tona. / Eurodiesel (Ultra Light Sulphur Diesel 10 ppm) must comply with the latest edition of MEST EN 590 and with the Rulebook on the Quality and Quality Control of Petroleum-Based Liquid Fuels (Official Gazette Nos. 1/2016 and 21/2021), with a sulphur content of 10 ppm and a maximum CFPP (Cold Filter Plugging Point) value of –15°C. Količina: 1 metrička tona /metric tonne NAPOMENE Razlog hitnosti za skraćenje roka za podnošenje ponuda je obaveza naručioca da sprovede ovaj postupak nabavke u 2025. godini radi ispunjenja mjerila za zatvaranja pregovora o poglavlju 15 energetika (formiranje obaveznih rezervi naftnih derivata saglasno Direktivi 2009/119/EC). Naručilac nije mogao uticati na to da se ova nabavka sprovede ranije, jer skladišni kapaciteti u Crnoj Gori, bilo u svojini države bilo u privatnoj svojini, nisu bili raspoloživi, a osiguranje skladišnih kapaciteta je ključan preduslov za pokretanje postupka nabavke goriva. Naručilac je zaključio Ugovor o skladištenju 04. decembra 2025. godine. Vlada Crne Gore je radi povećanja sigurnosti snabdijevanja Akcionim planom formiranja obaveznih rezervi naftnih derivata koji je donijela 26. decembra 2024, godine i Godišnjim planom formiranja i oržavanja obaveznih rezervi naftnih derivata za 2025. godinu Uprave za ugljovodnike koji je Vlada donijela 31. jula 2025. godine prioritetizovala skladištenje obaveznih rezervi naftnih derivata u Crnoj Gori u odnosu na skladištenje u inostranstvu. Naručilac nije mogao uticati na raspoloživost skladišnih kapaciteta na teritoriji Crne Gore a koji su u privatnoj svojini, jer je resorno ministarstvo u Grčkoj odobrilo čuvanje obaveznih rezervi Jugopetrola u Grčkoj tek u novembru 2025. godine, a dotad je Jugopetrol kao zakonski obaveznik formiranja dijela obaveznih rezervi morao skladišti svoje obavezne rezerve isključivo na naftnom terminalu u luci Bar. Pored toga, naručilac nije mogao uticati niti na raspoloživost skladišnih kapaciteta u svojini države, jer njihova obnova koju sprovodi ministarstvo nadležno za energetiku još uvijek nije ugovorena, iako je početak radova bio planiran za prvi kvartal 2025. godine. /he reason for the urgency and the shortening of the deadline for submission of bids is the contracting authority's obligation to conduct this procurement procedure in 2025 in order to fulfil the criteria for closing the negotiations under Chapter 15 - Energy (establishment of mandatory reserves of oil products in accordance with Directive 2009/119/EC). The contracting authority was not in a position to initiate this procurement earlier, as storage capacities in Montenegro, whether in state ownership or private ownership, were not available, while the securing of storage capacity constitutes a key precondition for commencing the fuel procurement procedure. The contracting authority concluded the Storage Agreement on 4 December 2025. For the purpose of enhancing security of supply, the Government of Montenegro, by adopting the Action Plan for the Establishment of Mandatory Oil Product Reserves on 26 December 2024, and the Annual Plan for the Establishment and Maintenance of Mandatory Oil Product Reserves for 2025 of the Hydrocarbons Administration on 31 July 2025, prioritised the storage of mandatory oil product reserves within Montenegro over storage abroad. The contracting authority could not influence the availability of storage capacities on the territory of Montenegro held in private ownership, since the competent ministry in Greece approved the storage of Jugopetrol's mandatory reserves in Greece only in November 2025. Until that time, Jugopetrol, as a statutory obligor for forming a portion of the mandatory reserves, was required to store its mandatory reserves exclusively at the oil terminal in the Port of Bar. Furthermore, the contracting authority could not influence the availability of storage capacities owned by the state, as their refurbishment, implemented by the ministry responsible for energy, has not yet been contracted, notwithstanding that the commencement of works had been planned for the first quarter of 2025.
